INRIA INTERSURF Software License Agreement This Software "INTERSURF 1.0" is copyright INRIA 2003-2004. Software: INTERSURF, version 1.0 of June 2004, hereinafter referred to as "the Software". In the sequel "the Software" means a run, a modification, a distribution or an integration of either the Software or of its generated files. 1. The Software has been designed and implemented by Nicolas RAY, and Xavier CAVIN, research workers for the Institut National de Recherche en Informatique et en Automatique (hereinafter "INRIA") - Domaine de Voluceau - Rocquencourt - 78153 Le Chesnay Cedex - France. INRIA, hereinafter referred to as the "Owner", hold all the ownership rights on the Software. The software has been registered at Agence pour la Protection des Programmes (APP) under the number IDDN.FR.001.440008.00.S.C.2004.000.1000. 2. The Owner freely grants the right to use the Software for academic, research and internal business purposes only, e.g. not for commercial use (see Clause 5 below), without a fee. Any use or reproduction of the Software to obtain profit or for commercial ends being subject to obtaining the prior express authorization of the Owner. 3. The user agrees that any reports or published results obtained with the Software will acknowledge its use by the appropriate citation as follows: "INTERSURF is a VMD plugin that was developed by the INRIA (Institut National de Recherche en Informatique et en Automatique - France). VMD was developed by the Theoretical and Computational Biophysics Group in the Beckman Institute for Advanced Science and Technology at the University of Illinois at Urbana-Champaign." Any published work which utilizes the INTERSURF VMD plugin shall include the following references: "Ray, N., Cavin, X., Paul, J.-C. and Maigret, B., `Intersurf: Dynamic Interface Between Proteins', J. Molecular Graphics, 2005, Volume 23, Issue 4, Pages 347-354." "Humphrey, W., Dalke, A. and Schulten, K., `VMD -Visual Molecular Dynamics', J. Molecular Graphics, 1996, vol. 14, pp. 33-38." Electronic documents will include a direct link to the official INTERSURF page at http://www.loria.fr/projets/docking/ and to the official VMD page at http://www.ks.uiuc.edu/Research/vmd/ 4. INRIA authorizes any reproduction of the software: - in limits defined in clauses 9 and 10 of the Berne agreement for the protection of literary and artistic works, which respectively specify in their paragraphs 2 and 3 authorizing only the reproduction and quoting of works on the condition that: "this reproduction does not adversely affect the normal exploitation of the work or cause any unjustified prejudice to the legitimate interests of the author", "that the quotations given by way of illustration and/or tuition conform to the proper uses and that it mentions the source and name of the author if this name appears in the source", - under the condition that this file is included with any reproduction. 5. Any commercial use made without obtaining the prior express agreement of INRIA would therefore constitute a fraudulent imitation. Commercial use of the Software, or derivative works based thereon, REQUIRES A COMMERCIAL LICENSE. Should Licensee wish to make commercial use of the Software, Licensee will contact INRIA (cdri@loria.fr) to negotiate an appropriate license for such use. Commercial use includes: (1) integration of all or part of the Software into a product for sale, lease or license by or on behalf of Licensee to third parties, or (2) distribution of the Software to third parties that need it to commercialize product sold or licensed by or on behalf of Licensee. 6. The Software being currently developed, INRIA is assuming no liability, and should not be responsible, in any manner or any case, for any direct or indirect damages sustained by the user.
